How will I be contacted?

A. Purchase-related information
If you have purchased a product, we will send you purchase related information by email. This may include the following:
- Purchase confirmations
- Information about the renewal or expiration of a product
- Necessary information for account management
Purchase-related information is contract-relevant information and therefore not a newsletter. You can not unsubscribe from purchase-related information. Purchase-related information is sent only within the scope of an active product.
B. Account-related information
If you have created a customer account and use it as part of a product, we may send you account-related information, if you allow us to do so. For example, this information may include the following topics:
- Information about new versions or features of the product
- Information about the download or demo versions
- Tips and tricks to help you get the most out of your product
Account-related information is customer-specific information. This information can be unsubscribed at any time. To do so, click on the corresponding button or link in the email you have received. No costs arise that exceed the basic costs of transmission.
C. Information by newsletter
If you are subscribed to our newsletter, we may send you newsletters from time to time. As an example these newsletters may cover the following topics:
- Information about offers or promos
- Information about new products from us
- Information about similar and or compatible products of our partners
You can unsubscribe from newsletters at any time. To do so, click on the corresponding button or link in the email you have received. No costs arise that exceed the basic costs of transmission.
The legal bases for the respective contact are set out in the processing purposes described above. We send purchase-related information insofar as this is necessary for contract performance. You can unsubscribe from account-related information and newsletters at any time using the unsubscribe link in the respective email.
Will data be shared? If so, with whom?
Data storage and processing by companies of the equinux group
For the execution of the contract and the use of product functionalities, your data can be stored and processed by all equinux Group companies under this privacy policy.
Data storage and processing by third parties
In a networked world, companies work together to provide the best possible products and services. We’re no different: For the sale and operation of our products, we rely on specialized service providers and processors. These include, for example, payment service providers, cloud storage and processing providers, and shipping service providers.
External service providers who process data on our behalf are carefully selected and subject to strict contractual requirements. They work according to our instructions and must adhere to appropriate technical and organizational measures to protect personal data. Where these service providers process personal data on our behalf, we enter into data processing agreements with them pursuant to Art. 28 GDPR.
Let’s be clear: We do not sell your data to these service providers; data is only transmitted to third parties in accordance with this Privacy Policy.
Data access for legal reasons
In specific cases, personal data may be shared with professional advisers (for example, accountants, lawyers, business consultants) or government agencies (such as tax offices, regulators). This is solely for the purpose of receiving professional advice, reviewing and defending legal claims, such as in litigation or out of court proceedings, in the context of regulatory investigations or proceedings, or as a result of other legal obligations.
Sale of the company or product
Your personal data may also be transferred to a third party if the company or part of it is sold. Since the sale of a company or product always includes the associated customer data, it would be transferred in this case. Any potential buyer is required to handle the personal information in accordance with this Privacy Policy.
Data transmission abroad
equinux is a global group of companies with subsidiaries, business processes, management structures and technical systems, some of which are located abroad. This means that your personal information may be transferred to other countries, possibly outside the EU. In other countries, there are other legal provisions regarding data protection. equinux makes sure that adequate protection for your data is ensured. This includes, for example, the use of standard agreements approved by the competent authorities and the requirement to take appropriate technical and organizational security measures to protect your personal data. Where personal data is transferred to countries outside the European Union or the European Economic Area, we ensure that an adequate level of data protection is in place. This may be achieved, in particular, through an adequacy decision by the European Commission, EU Standard Contractual Clauses, additional technical and organizational safeguards, or another legally recognized basis.
How long will my data be stored?
We store your personal data only for as long as necessary for the purposes for which it was collected, or for as long as statutory retention, documentation, or limitation periods apply. Contract and account data is stored for the duration of the contractual relationship and thereafter only to the extent necessary to comply with legal obligations or to establish, exercise, or defend legal claims. Invoice, payment, and transaction data is stored in accordance with statutory commercial and tax retention obligations. Support requests, technical log data, usage data, and diagnostic data are stored only for as long as necessary to process the request, ensure secure operation, analyze errors, or improve our products and services. If you request deletion of your data, we will delete your personal data unless statutory retention obligations, existing contractual relationships, or other legal grounds prevent deletion.
Does automated decision-making take place?
Automated decision-making, including profiling pursuant to Art. 22 GDPR, does not take place.
How secure is my data?
We use technical and organizational security measures to protect the data you provide against loss, destruction or access by unauthorized persons through accidental or intentional manipulation. We constantly improve our security measures based on the current state-of-the-art.
Are cookies used? Which known analytic tools are used?
When using our website
We use technically necessary cookies and similar technologies where this is required for the operation of our website and services. Cookies are small text files in which data can be stored on your device. Analytics, marketing, and advertising cookies, as well as similar technologies, are used only where consent is required and you have given such consent. You can prevent cookies from being set by adjusting your browser settings. You can also withdraw consent you have given with effect for the future via the cookie settings or the corresponding settings in the product. Please note that some website or product functions may not be fully available if cookies are disabled.
Use of Google AdSense
Some equinux products use Google AdSense, a service for displaying advertisements provided by Google. Depending on the contractual relationship, the provider is a company of the Google group, in particular Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, or Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google AdSense may use cookies, web beacons, advertising IDs, and similar technologies to display advertisements, evaluate the use of advertisements, and prevent misuse. In this context, information about the use of equinux products, your IP address, device and browser information, and information about the delivery of and interaction with advertisements may be processed.
Where Google AdSense uses cookies, advertising IDs, or similar technologies that are not technically necessary, this only takes place on the basis of your consent pursuant to Art. 6(1)(a) GDPR in conjunction with Section 25(1) TDDDG. You can withdraw your consent at any time with effect for the future via the cookie settings or the corresponding settings in the product.
